Branding

Of course, this is just business speak for stuff you already knew was important, like your image.  Bands, like businesses, work best if they have a focussed and defined brand, which is shown on all of their promotional materials.  You should decide on a logo, and keep it consistent across anything you put out, from record sleeves and flyers to your web presence (which includes your own website and any social media pages for the band).  Your brand is more than just your logo, however, it is the unique package that makes your band what it is, which is what you want your new fans to be able to easily get a sense of.

Marketing and Promotion

As an artist, you want to be heard.  As a business, you want to make money.  The only way to achieve either of these things is to make as many people as possible aware of what you are doing.  Marketing and promotion is not just about making sure your next gig is well advertised, it is also about researching your target demographic – which means learning what else people who like your genre of music are doing in any city you want to play in and tapping into things that will help make them aware of you and that you are one of the professional bands for hire, who play the type of music they are looking for.

Networking

There are very few things you can try and do where knowing the right people doesn’t help and music is no exception.  Obviously sidling up to record company executives and trying to become their new best friend hardly ever works, but use any opportunity you get, physically and via social media, to build relationships with people either in the music industry or in complimenting fields, such as owners of venues where you could play, bloggers who could review your gigs and people who can provide services you might need (such as wedding photographers or guitar shops).

Finance

You need to be able to plan and forecast the spend involved in things like touring, producing merchandise, advertising and so on versus potential return on investment. This is sometimes something you can do quite easily – for example how many ticket sales you’d need to make or how much a venue would need to pay you to make a tour or gig worthwhile in money terms (of course this is much easier if you play corporate entertainment for fixed prices). In other cases, you have to deal with more long term or abstract ideas, like whether the increased exposure a tour would give you would make it worth, in the long run, making a loss on actually doing it and advertising it. of course location can be quite relevant these days with the cost of fuel to consider, so if you are one of the party bands who are based in Devon, then try to find local gigs, as the costs will begin to spiral if you are playing a wedding in Hampshire not to mention the extra time involved in traveling.

The Legal Services Commission (LSC) administers the legal aid fund on behalf of the government.  Firms of solicitors are not automatically included in the legal aid scheme but instead have to apply for a franchise.  The franchise permits them to place the legal aid logo on their marketing documentation (business cards, letterheads, compliments slip, along with any advertising for their firm).  If a firm of solicitors is not part of the legal aid scheme, then they are not permitted to display information suggesting that they are.

Legal Aid Funding Costs

The cost of the programme presently stands at £2.1 million pounds annually.  The budget level, within England and Wales, is being challenged on the basis that it is too costly to fund and some cases are unnecessarily paid for under the legal aid scheme.

Legal Aid Cuts

The Ministry of Justice is proposing to cut the funding by £300 million pounds to £1.8 million.  This proposal is due to return to parliament for further debate soon.  Opposition to the cuts are most vocal from workers within the legal profession and campaigners for equal access to legal rights.  The Law Society themselves weighed in on the proposed cuts by stating that such cuts would hurt the “weak and vulnerable”.

Justice Secretary Ken Clarke has previously told parliament and recently on a BBC Radio 4 programme, that the existing system of legal aid unnecessarily funds cases such as divorce cases that should not fall under the legal aid scheme.  Furthermore, his opinion is that the prevalence of legal aid provides an opportunity for individuals to become more litigious than they would otherwise be because they are not paying for the full cost of litigation.

The proposed cuts include:

• Some divorce cases and child custody battles
• Clinical negligence claims
• Employment and educational law
• Immigration cases, excluding matters arising from location of detainment
• Housing and benefits, and some debt related cases

However, in addition, it is being proposed that extra resources are put towards cases that relate to domestic violence.  These were not previously under coverage and the proposals specifically relate to mental and sexual abuse cases.

Means and Merits

Legal aid is not a right and it is not free money.  Whether someone will have to repay the LSC back will depend partly on the outcome of the case.  If the case is won, but your legal costs are not fully met by the other party, then the benefactor will possibly need to repay the LSC back in the future when they have the means to do so.

Eligibility Test

The basic exclusion is whether you have a gross (pre-tax) monthly income of more than £2,657 per month.  If you do, you are not eligible.  If you have a disposable monthly income of more than £733 per month, then again you are not eligible.  In addition, if you have too much capital in equity in your home or in other forms of assets such as cash, savings or investments, which exceed £8,000, again you will not be eligible.

Intention of Legal Aid

The legal aid programme is intended to help low income and/or low capital asset ownership individuals who have need for legal funding on cases that fit within the funding profile supported by the programme itself.

How this will affect no win no fee solicitors in the UK is not yet clear, however the medical negligence cases are a target. I asked my local swindon solicitors how they expected the changes to affect their no win no fee business, but he was as yet unsure.

In my opinion there are three key ingredients to making a successful band, fistly and most obviously the music itself, then there are the musicians and finally and rather surprisingly, is the bands name. So lets have a look at each of these elements one by one:

1. THE MUSIC

You need to decide on your style, and when I say that you don’t need to say we are rock or pop but unless you find other band members with vaguely similar tastes you may struggle with cohesion with the members, but I’ll come to that a bit later. What I mean is having a general theme, or influences. You also need to know if you will write your own songs or play covers, generally speaking the professionals who are not famous tend to play covers, these groups often play weddings, and private functions. If you are going to play pubs you need a mix of both original and covers, leaning more towards the covers side, but if you really want to make it you will probably write your own songs. This approack is incredibly hard, even if you are exceptionally good and the success rate (even to break even) is very very low, but obviously if you do make it the rewards are enormous.

2. THE BAND MEMBERS

Who you work with will make an enormous difference to the overall sound you have and will make or break the band if you all do or don’t get on well both on a professional and personal level, remember you could spoend quite a bit o time in each others company.

You need to make sure you find people with similar levels of commitment and flexibility, as the last thing you want is to work hard to get a gig only to find out that the drummer has his map reading lesson every Friday night! It’s also nice to have your regular practice night, but also for the drummer and bass player to get together for jamming sessions together sometimes, likewise if the guitarist and vocalist are the main songwriters they will need to spend time together working on riffs and vocals.

It’s important to be open minded too, especially when writing your own songs. If you play blues, there could be some interesting influences which could be gleaned from genres as diverse as drum and bass, country or classical, the only limitations are your own imagination, so it’s essential to try new things out.  Most of the time you will try something and it just won’t gel, but every now and then you will hit on a great new idea that just might make you stand out from the crowd.

Band experience, whilst it’s not essential that all members are seasoned gig players, it’s nice to know that they have a few live gigs under their belts, as the last thing you want, is to turn up to play your first live concert and find the bass player has stage fright.

3. THE BANDS NAME

It’s almost impossible to tell you how to name a band, but the easy way to give it the best chance is to write down the name of all the biggest bands in your genre and the names of the upcoming ones too, see if you can find some similarities in them, then try to find a name which fits into the musical genre, so again this goes back to the decision of what type of music to play.

Who made the Stonehenge? There are different theories as to who actually made the Stonehenge.
